Terms of Use
Last updated: October 14, 2026
These Terms of Use (“Terms”) apply to your use of Millandollarmarketing.com and to digital marketing services provided by Millan Dollar Marketing (“M.D.M.” “we,” “us,” or “our”). We are based in Charlotte, North Carolina, and offer services remotely to clients in the United States.
Acceptance and Scope
By using the website, submitting a form, or purchasing or engaging us for services, you agree to these Terms. If you do not agree, do not use the website or purchase services through it.
We offer logo design, website design, graphic design, social media management, website management, and Google Business Profile management. The exact scope, deliverables, schedule, fees, and any service-specific conditions will be described in the applicable written proposal, order, invoice, or other project agreement (a “Project Agreement”). A Project Agreement controls if it conflicts with these Terms for the services it covers.
The website does not create customer accounts. These Terms do not create a partnership, employment, franchise, or joint venture relationship.
Client Responsibilities
You agree to:
- provide accurate, timely information, materials, access, and instructions needed for the work;
- ensure you have the rights and permissions to give us any text, images, logos, credentials, or other materials you provide;
- review drafts and requests for approval promptly, and identify any errors or changes before approving or publishing work;
- ensure that claims, offers, testimonials, reviews, promotions, and other content you ask us to use are accurate and lawful, and provide any legally required disclosures;
- maintain control of your accounts and protect login credentials, and give us only the access needed for the agreed work; and
- use the website and services lawfully and not interfere with their security or operation.
You are responsible for final review and approval of content and for the accuracy of information about your business, products, and services. We may pause work if required information, access, payment, or approval is missing. Any effect on timing or additional charges should be addressed in the Project Agreement.
Fees, Payments, and Taxes
Fees, payment timing, accepted payment methods, deposits, recurring charges (if any), and applicable taxes will be shown at checkout or stated in your Project Agreement or invoice. You authorize the applicable payment provider to process payments you submit. Payment information may be handled by that provider under its own terms and privacy practices.
Unless the Project Agreement states otherwise, fees are due on the dates shown in the applicable invoice or checkout. You are responsible for applicable taxes, other than taxes on our income. We may pause work for overdue amounts after giving any notice required by law or the Project Agreement.
Cancellations, Termination, and Refunds
You may request cancellation by contacting us at Millandollarmarketing@gmail.com. Unless a Project Agreement states a different lawful arrangement, you remain responsible for fees for work performed and approved, and for reasonable non-cancellable costs incurred for your project through the effective cancellation date. Any prepaid amount for work not performed will be handled under the Project Agreement and applicable law. All deposits are non-refundable once work has started. All sales are final and no we offer no refunds for completed work.
Either party may end a Project Agreement as described in that agreement. We may suspend or end access to the website or services if necessary to address misuse, a security risk, nonpayment, or a material breach, subject to applicable law and any required notice. Ending a project does not remove payment obligations already incurred or terms that by their nature should continue, including intellectual-property, disclaimer, liability, and dispute provisions.
Intellectual Property and Project Materials
You retain ownership of materials you provide to us. You give us permission to use those materials as reasonably needed to perform the agreed services, and you confirm that you have the rights to grant that permission.
The Project Agreement should specify when rights to custom deliverables transfer to you and whether the transfer depends on full payment. Until that arrangement is stated, do not assume a proposal, draft, concept, unused design, source file, template, or working file is included in a transfer.
Our pre-existing materials, methods, know-how, tools, templates, and reusable components remain ours. Third-party materials, fonts, stock assets, software, platform features, and other licensed items remain subject to their own license terms and may require separate fees or attribution. We will identify material third-party restrictions in the Project Agreement where applicable.
Unless you tell us otherwise in writing and the Project Agreement permits it, we may identify you as a client and display publicly released work in our portfolio.
Marketing Results and Third-Party Platforms
Marketing outcomes depend on many factors outside our control, including your market, audience, budget, offer, competition, and changes to third-party platforms. We do not promise a particular search ranking, number of leads, sales, followers, engagement level, revenue, review rating, or approval or availability of a third-party platform or profile.
Social networks, search engines, website hosts, and other platforms are operated by third parties and may change their features, rules, access, or availability. Your use of those platforms is also subject to their terms. We are not responsible for a third party’s actions or service interruptions, except to the extent applicable law does not allow that limitation.
Website Use and Content
You may use the website for lawful purposes only. You must not attempt to disrupt, damage, reverse engineer, or gain unauthorized access to the website, its systems, or another person’s data, or submit material that infringes rights, is fraudulent, or is unlawful.
Website text and materials are provided for general information about our services. The website itself does not guarantee that a service is suitable for your specific needs; service commitments are set out in the applicable Project Agreement.
Disclaimers
To the extent permitted by law, the website and its general information are provided “as is” and “as available.” We do not make implied warranties about the website or general information, except for any warranties that cannot be excluded under applicable law. Any service-specific promises or warranties must be stated in the applicable Project Agreement.
Nothing in these Terms excludes a right or remedy that applicable law does not allow us to exclude.
Limitation of Liability
To the extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from the website or services, even if advised that such damages were possible.
To the extent permitted by applicable law, our total liability arising from a particular service or claim will not exceed the fees paid or payable to us for the specific services giving rise to the claim during the 12 months before the event that caused it. This limit does not apply to liability that cannot lawfully be limited.
Disputes and Governing Law
If you have a concern, contact us first at Millandollarmarketing@gmail.com with a description of the issue and how you would like it resolved. Both sides will try in good faith to resolve it informally. This does not prevent either side from pursuing a legal remedy or meeting a required filing deadline.
To the extent permitted by applicable law, North Carolina law governs these Terms, without regard to conflict-of-law principles. Any lawsuit relating to these Terms or the services must be brought in the state or federal courts located in Mecklenburg County, North Carolina, unless applicable law gives you the right to bring it elsewhere. Each party submits to those courts’ jurisdiction to the extent permitted by law.
These Terms do not create a mandatory arbitration requirement or waive any right to participate in a class or representative action.
Changes to These Terms
We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Changes apply prospectively from the posted effective date, unless applicable law requires a different process. A Project Agreement may separately govern services already purchased.
